Terms and Conditions
“This Agreement” is made by and between you (or “User,” referring to any individual or organization that registers, logs in, uses, or browses this service) and Beijing ManManXingTu Technology Co., Ltd. and its affiliated companies (hereinafter referred to as “MipMap” or “We”) regarding the products and services.
ManManXingTu hereby specifically reminds users to carefully read and fully understand all terms herein, including the terms that exempt or limit MipMap’s liability and the terms that restrict users’ rights. Please carefully read and choose to accept or not accept this Agreement (minors should read this Agreement in the company of their legal guardians). If you have any objections to any terms of this Agreement, you may choose not to use MipMap’s products and services.
1. MipMap Products and Services
1.1 Overview of MipMap Products and Services:
You can use MipMap products and services to reconstruct and analyze your datasets, and upload them to the cloud platform or web-based hosting platform, including ManManXingTu’s MipMap cloud platform.
1.2 You must be aware and confirm that:
1.2.1 We may, due to business development needs, unilaterally change, suspend, restrict, terminate, or revoke all or part of ManManXingTu’s products and services at any time without any notice. Users shall bear this risk;
1.2.2 MipMap products and services may include advertisements and other activities. Users agree to display advertisements and other activities provided by us, our affiliates, and third-party suppliers and partners during the use of the services;
1.2.3 We have the right to decide at our sole discretion to stop transmitting any content that violates relevant laws and regulations or the provisions of this Agreement, or infringes, hinders, or threatens the rights or safety of any person, and we have the right to take appropriate legal actions against any person who violates this Agreement, including but not limited to deleting illegal, infringing, or inappropriate content from MipMap products and services, terminating the violator’s login, preventing them from using all or part of our MipMap products and services, and preserving relevant information and providing reports as required by relevant authorities, all in accordance with the law.
2. User Registration and Account
2.1 Registration and Account:
2.1.1 Account Registration
You may be required to register a user account and log in before using the products or services we provide. In accordance with the “Regulations on the Administration of Information Services of Mobile Internet Applications,” you must bind your user account to a mobile phone number based on real-name registration. In addition, you need to provide relevant true personal information on the registration page, including but not limited to your name, email address, and contact phone number. We may send you business notifications (including bills), business communications, product promotions and introductions, etc., through the above information.
2.1.2 Account Use
Your account is for your personal use only. It is prohibited to transfer, lease, sell, or authorize others to use your account. If any abnormal use behavior is found, this platform has the right to suspend or terminate the use of the account. If your account is found to be stolen or there are other security issues, please notify us immediately so that we can take appropriate measures.
2.1.3 Account Cancellation
You can apply to cancel your account by contacting customer service or through the tools provided on the platform. After the account is canceled, we will delete or anonymize your personal information in accordance with legal requirements, but relevant records may be retained for a period of time due to legal provisions.
2.1.4 Issuing Invoices
After you complete registration and select specific services, in order to issue and send you invoices, we will collect invoicing information including but not limited to your name and taxpayer identification number, as well as invoice recipient information including the name, contact phone number, address, and postal code for mailing or online delivery. We will issue and send invoices based on the above information and ensure the security and confidentiality of the information.
2.2 Customer Notification and Presumption
2.2.1 Service Notification
In order to provide you with better services, we may send you the following information via email, SMS, in-app messages, or other means: important notifications such as account registration and password reset; service-related reminders such as order status and transaction information; and platform updates, policy adjustments, or security warnings.
These service notifications are part of the service, and you may not be able to unsubscribe from them.
2.2.2 Marketing Promotion Notification
We may send you information about promotional activities, promotions, or personalized recommendations via SMS, email, or other means. If you do not wish to receive such marketing information, you can unsubscribe through the following methods: reply “TD” or other designated codes to SMS messages; click the “Unsubscribe” link in emails; or turn off relevant notification permissions in the application settings.
2.2.3 Unsubscribing from Promotional SMS Messages
Unsubscription method: Each promotional SMS message will include a clear unsubscription method (such as replying “TD” to unsubscribe). You can also contact customer service to request unsubscription from promotional SMS messages.
Scope of unsubscription: Unsubscription applies only to marketing promotion information, not to service-related notifications (such as order confirmation and payment reminders).
Processing time: We will process your unsubscription request as soon as possible, usually within 48 hours. However, due to technical or other uncontrollable reasons, you may still temporarily receive information. Thank you for your understanding.
Resubscription: If you wish to receive promotional SMS messages again after unsubscribing, you can contact customer service or re-enable the relevant notification permissions in the application.
2.3 You must promise and guarantee that:
2.3.1 You understand and agree that MipMap is an application service product, and you shall be fully responsible for the authenticity, legality, and validity of your registration information. You must not impersonate others or use another person’s name to use MipMap products and services or publish any information; you must not maliciously use registered accounts to cause other users to misunderstand; otherwise, we have the right to immediately stop providing any services, including MipMap products and services, and you shall bear all legal responsibilities arising therefrom;
2.3.2 Your use of MipMap products and services must be legal. You must be responsible for all actions under your registered account, including any content you publish through MipMap and any consequences arising therefrom. Users should make their own judgments about the content and functions and bear all risks arising from the use, including the risks arising from reliance on the correctness, completeness, or practicality of the content and functions. MipMap cannot and will not be liable for any loss or damage caused by user behavior;
2.3.3 You are responsible for keeping your login information confidential and preventing it from being obtained and used by others, and you are responsible for all actions under your MipMap account. You must notify us immediately of any behavior that may violate the law, unauthorized use, or suspected unauthorized use. We are not responsible for any losses caused by your failure to comply with the above requirements.
2.3.4 The information you publish through MipMap is public information, and other third parties can obtain the information you publish through this platform. Your publication of any information means that you acknowledge that the information is public, and you shall bear legal responsibility for this behavior separately. Any user who does not want their information to be known by other third parties should not publish it on this platform.
3. User Content
3.1 User Content:
User content refers to all content generated by the user when downloading, publishing, or otherwise using MipMap products and services. You are solely responsible for your user content, and you will bear the risk of your or any third party being identified due to the disclosure of your user content.
3.2 License:
When you use your user content in connection with MipMap products and services by uploading, publishing, distributing, or other means, you automatically grant and promise and guarantee that you have the right to grant us an irrevocable, non-exclusive, royalty-free, and fully paid global license.
3.3 Third-Party Content:
MipMap products and services contain user content provided by other users. Your interactions with other users are solely between you and other users. MipMap does not control and is not legally responsible for such user content, nor does it have the obligation to inspect, monitor, approve, or ratify such user content. You shall bear legal responsibility for the risks arising from the use of such user content and interactions with other users. MipMap does not assume any legal responsibility for such behavior.
4. User Rights and Obligations
4.1 The right to legally use MipMap and MipMap products and services;
4.2 The right to download, install, and use MipMap products and services on your legally owned devices;
4.3 The ownership of the user account belongs to MipMap and its affiliated companies. For account security considerations, it is prohibited to use other people’s mobile phone numbers, email addresses, ID card numbers, or bank account numbers to register a MipMap account. After you complete the application and registration procedures, you obtain the right to use the MipMap account. This right of use belongs only to the initial applicant and is prohibited from being given as a gift, borrowed, rented, transferred, or sold. MipMap has the right to reclaim the user’s account due to business needs;
4.4 You have the right to change or delete your personal information, registration information, and published content on MipMap. However, you should note that deleting relevant information may also delete any text and images you have stored in the system. Users shall bear this risk;
4.5 You are responsible for properly keeping your registered account information and account password secure. You need to bear legal responsibility for the actions under your registered account and password. You agree not to use other members’ accounts or passwords under any circumstances. When you suspect that others are using your account or password, you agree to notify MipMap immediately;
4.6 Rights Restrictions:
4.6.1 You must not license, sell, lease, transfer, distribute, or make any other commercial use of MipMap content or MipMap products and services in any form;
4.6.2 You must not access MipMap or use MipMap products and services for the purpose of creating the same or competitive services;
4.6.3 Unless expressly stipulated by law, you must not copy, distribute, republish, download, display, post, modify, translate, combine, utilize, disassemble, or reverse compile any part of MipMap products and services (including but not limited to content or advertisements or sponsored content in the products) in any form or method;
4.6.4 You shall bear legal responsibility for the risks arising from your use of third-party websites and advertisements. When you access third-party websites and advertisements, the terms and policies of the third party apply;
4.6.5 You agree that by uploading, publishing, or otherwise using MipMap products and services, you will bear all legal responsibilities for the risks caused by the following behaviors in the process of using the services:
- Undermining the basic principles established by the Constitution;
- Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
- Damaging national honor and interests;
- Inciting ethnic hatred and ethnic discrimination, and undermining national unity;
- Undermining national religious policies and advocating cults and feudal superstitions;
- Spreading rumors, disrupting social order, and undermining social stability;
- Disseminating obscene, pornographic, gambling, violent, murderous, terrorist, or crime-instigating content;
- Insulting or slandering others, infringing upon the legitimate rights and interests of others;
- Containing other content prohibited by laws, regulations, and administrative rules;
- Other behaviors that violate national laws and regulations or have a negative impact on society.
4.6.6 You agree not to engage in the following behaviors on MipMap or using MipMap products and services:
4.6.6.1 Uploading or publishing computer viruses, worms, malicious code, software that deliberately destroys or alters computer systems or data; collecting other users’ information or data, such as email addresses, without authorization;
4.6.6.2 Disabling MipMap’s network connection, causing excessive burden on MipMap, or otherwise interfering with or damaging website servers and network links;
4.6.6.3 Interfering with or disrupting other users’ normal use of MipMap products and services.
5. Indemnification
5.1 You must use MipMap products and services in accordance with the provisions of laws, regulations, and this Agreement, and avoid MipMap from suffering any complaints and/or lawsuits from third parties due to the following behaviors or related behaviors, and bear any losses, damages, liabilities, costs, and expenses (including but not limited to attorney fees) arising therefrom:
5.1.1 Your use of MipMap products and services;
5.1.2 Your user content;
5.1.3 Your violation of this Agreement.
5.2 You agree that unless you obtain written consent from MipMap, you shall not unilaterally settle in any lawsuit you jointly file with MipMap against a third party.
5.3 Under any circumstances, MipMap shall not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages arising from this Agreement to you or any third party. For the avoidance of doubt, you shall bear the risk of damage to your computer system or mobile communication device database arising from accessing and using MipMap products and services.
6. Disclaimer
6.1 MipMap shall not bear any legal responsibility under the following circumstances:
6.1.1 Monitoring, collecting, and providing your personal information in accordance with legal provisions, the requirements of relevant government departments, or national security regulatory requirements;
6.1.2 Any leakage of personal information due to your improper use or other personal reasons;
6.1.3 Any service interruption or obstruction that fails to meet user requirements due to hacker attacks, computer virus intrusion, blocking of illegal content information and harassing information, government control, and any other network, technical, communication line, information security management measures, etc.;
6.1.4 Any penalties and losses suffered by users due to their violation of laws and regulations in using MipMap products and services;
6.1.5 Losses caused to users by third-party operators’ communication line failures, technical problems, network or computer failures, system instability, and other force majeure circumstances;
6.1.6 Risks arising from information containing threats, defamation, offensiveness, or illegal content from others’ anonymous or impersonated use of MipMap products and services;
6.1.7 Any psychological or physiological harm and economic losses that users may incur due to being misled or deceived when interacting with other users through MipMap products and services.
6.2 Any content published by users on MipMap does not represent or reflect any views or policies of MipMap, and MipMap does not assume any responsibility for this.
6.3 Under any circumstances, MipMap shall not be liable for any indirect, consequential, punitive, incidental, special, or criminal damages, including loss of profits due to the user’s use of MipMap products and services. Notwithstanding any conflicting provisions in this Agreement, our total liability to you, regardless of the cause or manner of action, shall not exceed the fees (if any) you paid to MipMap for using MipMap products and services during the registration period.
7. Intellectual Property
7.1 The information published by users in the process of using MipMap products and services must not infringe upon the intellectual property rights of any third party. Without the prior written consent of the owner of the relevant ownership, users must not upload, publish, modify, disseminate, or reproduce any copyrighted materials, trademarks, or proprietary information belonging to others in any way. If we receive appropriate notice from any copyright owner or its legal representative, we will remove such content that infringes upon the copyright of others based on our review.
7.2 The copyright of the original content published by users in the process of using MipMap products and services belongs to the users themselves, and users can authorize any third party to use it in any way. For content edited by multiple people, including but not limited to question and supplementary explanations, answer summaries, topic descriptions, and topic structures, all participants agree that the relevant intellectual property rights belong to MipMap.
7.3 Users grant MipMap a free, irrevocable, non-exclusive license to use all content published by them in the process of using MipMap products and services. MipMap has the right to use this content in various forms on various forms of MipMap’s products and services, including but not limited to websites, applications, media, or others.
7.4 The MipMap logo and product, service names, pictures, graphics, etc., involved in MipMap products and services are protected by copyright, trademarks, and other laws. Without the prior written consent of MipMap, users must not display or use the above content in any way or make other treatments. No unit or individual may use, copy, modify, disseminate, transcribe, or bundle and sell the trademark or any part thereof with other products in any way or for any reason.
7.5 MipMap products or services contain content owned by or licensed to MipMap (referred to as “MipMap Content”). MipMap Content is protected by copyright, trademark, patent, trade secret laws, and other laws, and between you and MipMap, MipMap owns and reserves all rights to MipMap Content and MipMap products or services. You must not delete, change, or cancel any copyright, trademark, service mark, or other proprietary rights notices attached to or contained in MipMap Content, nor may you copy, change, adapt, perform, display, publish, disseminate, transmit, broadcast, sell, license others to use MipMap Content, or create derivative works based on it, or otherwise utilize MipMap Content.
7.6 In particular, you understand and agree that all materials we provide (including but not limited to fonts, format styles, filters, stickers, watermarks, music, etc.) are only for your use in shooting and editing short videos through MipMap products or services and as a component of such short videos. You must not separate the materials provided by us from the aforementioned short videos or use such materials separately in any form. You understand and agree that the short videos you shoot and edit using the above materials through MipMap products or services must not be used for any commercial purposes.
7.7 In addition to the foregoing provisions, if you believe that someone has copied and published your work on MipMap products and services, which constitutes an infringement of your copyright, please contact us in a timely manner and provide a written notice containing the following information:
- Proof of ownership proving your ownership of the allegedly infringing content;
- Clear identification of identity, address, and contact information;
- The location of the allegedly infringing content on MipMap products and services;
- A description of the copyrighted work you claim has been infringed;
- Relevant proof of your copyright being infringed;
- A written statement declaring that the content described in your notice is accurate and true, under the premise of agreeing to bear the consequences of perjury.
8. Modification and Termination
8.1 Modification:
8.1.1 This Agreement allows for changes. If this Agreement is changed, we will announce the updated agreement on MipMap. After that, your continued use of MipMap products and services will be deemed as your acknowledgment of such changes and agreement to be bound by them;
8.1.2 MipMap reserves the right to modify, retain, or close MipMap products and services at any time without notice;
8.1.3 You agree that MipMap does not need to be liable to you or any third party for modifying, retaining, or closing MipMap products and services.
8.2 Termination:
8.2.1 This Agreement shall take effect from the date of your acceptance and shall remain valid during your use of MipMap products and services until termination in accordance with this Agreement;
8.2.2 Notwithstanding the above provisions, if you use MipMap products and services earlier than the time you accept this Agreement, if you know or should have known and agreed to this Agreement, then this Agreement shall take effect when you first use MipMap products and services, unless terminated earlier in accordance with this Agreement.
8.3 If the user infringes the copyright of a third party and MipMap receives notice from the copyright owner or its legal representative, MipMap reserves the right to terminate this Agreement.
8.4 Once this Agreement is terminated, your website account and your right to use MipMap products and services will also terminate. You should be aware that the termination of your website account means that your user content will be deleted from our active database. MipMap shall not be liable to you for terminating this Agreement, including terminating your user account and deleting your user content.
8.5 Any updated version of MipMap or future version, update, or other change of MipMap products and services will be bound by this Agreement.
9. Other
9.1 Feedback
If you make any suggestions to MipMap (or “Feedback”), it shall be deemed that you have transferred all rights of the “Feedback” to MipMap and agreed that MipMap has the right to use such Feedback and related information in any reasonable way. We will treat such Feedback information as non-confidential and non-proprietary.
9.2 Privacy Policy
9.2.1 Please refer to our “Privacy Policy,” which is an integral part of this Agreement and has the same legal effect. At all times, your information will be processed in accordance with the “Privacy Policy.”
9.2.2 MipMap will fully protect users’ personal privacy information. MipMap guarantees not to disclose users’ personal privacy information or non-public content stored by users when using the services to the public or any third party, unless MipMap needs to disclose users’ personal privacy information due to legal requirements, requirements from government departments with legal authority, or prior explicit authorization from the user, including but not limited to flight data generated by users during the use of MipMap products and services.
9.3 Notification
You must provide your most recently used and valid email address. MipMap shall not be responsible for any risks arising from your inability to use the email address you provided or our inability to deliver notifications to you for any reason. Announcements and notifications issued by MipMap and emails (if any) sent to you containing such notifications shall undoubtedly constitute valid notifications.
9.4 Applicable Law
This Agreement shall be governed by the laws of the People’s Republic of China. If any dispute arises between the parties, they shall negotiate in a friendly manner to resolve it; if negotiation fails, they shall file a lawsuit in the court where MipMap is located.
9.5 Independence
If some terms of this Agreement are inapplicable for some reason, the other terms of this Agreement shall continue to apply, and the inapplicable terms shall be modified so that they can apply in accordance with the law.
9.6 Completeness
This Agreement (including the Privacy Policy) is the final, complete, and exclusive agreement between you and MipMap regarding the relevant matters of MipMap products and services, and it supersedes and merges the previous discussions and agreements between the parties regarding such matters (including previous end-user licenses and terms of service).
9.7 Heading
The headings of each section are for reading convenience only and do not have any legal or contractual obligations.
9.8 Assignment
You may not assign the rights and obligations stipulated in this Agreement without the written consent of MipMap. Any attempt to assign in violation of the above provisions shall be invalid.
9.9 Software Subscription Agreement
Please refer to our “Subscription Agreement”. It contains the conditions of use of the software, subscription deduction and refund policy, please carefully read prior to purchasing our software.
Your registration, login, use, publication, and other behaviors shall be deemed as your acceptance of this Agreement and agreement to be bound by all the terms herein.
Your acceptance of this Agreement means that you voluntarily accept the binding of all terms, including accepting any modifications made by MipMap to any terms at any time. This Agreement may be updated by MipMap at any time. Once the updated terms are published, they shall replace the original terms without further notice. Users can view the latest version of the terms on MipMap. If the user does not accept the modified terms after MipMap modifies the relevant terms of this Agreement, please stop using MipMap products and services immediately. The user’s continued use of MipMap products and services will be deemed as acceptance of the modified agreement.
